Following terms of use describes the terms and conditions applicable to your access and use of the website Tradefixa.com and it's mobile application platform. This document is a legally binding agreement between you as the user(s) of the website or application platform referred to as "you" "your" or "user" . Rightview Digitech Pvt Ltd is referred to as "we" "our" or "Tradefixa" .

1. Application & Acceptance of the terms

We let you know that you, or User use the our platform or Tradefixa or our services like website, software, application all are subject to terms and conditions. We follow all rules and regulations according to our laws of company act and we follow all government policies which is related to e-commerce, logistics, transportation so we wish user also follow all these laws.

2. Provision of services

We both users and (Tradefixa) Rightview Digitech Pvt Ltd are agree to follow rules according to our agreement. In case of a avail services while accessing our platform that may be support or provided by third party services your contracting entity will be such third party service provider. Whenever user using there service directly or indirectly, Tradefixa disclaims all liabilities for any claims that may arise pursuant to your use of service provider. You must

register as a user on the platform in order to access and use services. Further Tradefixa reserves the right without prior notice to restrict access to or use of certain services or any features of services.

3. Users generally

 

3.1 You agree that you will not copy, reproduce download, republish, sell, distribute or resell any services or any information, text images, graphics, video, files, any type of data of customer i.e. contact number, address, email, listing, databases, video directories, all information available at Tradefixa platform.

3.2 You will not copy, download, compile, reproduce or otherwise use any content of Tradefixa platform. You can't reproduce any type of our property directly or indirectly, through manual, devices, spiders, robots or any type of theft. 

3.3 User must read third party T&C before using their services by using our platform ( in form of any link, banner, API, channels ). Tradefixa has no control our third party T&C so Tradefixa shall not be responsible for any liabilities.

3.4 User must know that they can't promotes any illegal or unauthorized copy of another person's company or firm such as providing pirated computer programming or links to them providing information to manufacturer, installed copy of pirated devices or providing pirated music or files.

4. User's responsibility

User must fill all information about him/her i.e. he/she must be 18 years old to agree with Tradefixa. User must upload all information about your business like address, email, images etc. You represents, warrants and agree that you shall be solely responsible for obtaining all necessary third party licenses and permissions.

5. User accounts

User must be registered on Tradefixa to access better experience of services. For better services Tradefixa shall delist any user without any advance notice. So user must read T&C and privacy policy of Tradefixa. One user may only operate one account on our platform. If any seller or service provider has to create second accounts on Tradefixa so client has to get special permission by our zonal manager.

6. Transactions between users

Customer must know any kind of transaction which is governed by individual contractual arrangement entered into directly between seller and buyer, Tradefixa does not represent the seller or buyer in specific transactions. Tradefixa doesn't responsible for quality, safety, lawfulness or availability of the platform or the ability of the seller to complete sell or buyer to complete purchase.

7. Limitation of liability

To follow maximum extent permitted by law the services provided by Tradefixa or through platform "as is" "as" available and with all faults and Tradefixa hereby expressly disclaims any and all warranties, Express implied, including but not limited to any warranties, representations, conditions and undertakings are hereby excluded.

8. Force majeure

User must know that, Under no circumstances shall Tradefixa be held liable for any failure daley or disruption of services or content delivered through the platform resulting directly or indirectly from act of nature, forces or causes beyond Tradefixa reasonable control including without limitation internet failure, computer, telecommunications or any other equipment failure. Electrical power failure, strikes, riots, labor disrupts, insurrections, civil disobediences, shortages of labour or material, fires, floods, storms, explosions, act of God, war, government actions, orders of domestic or foreign courts or tribunals or non performance of third arties.

9. Intellectual property rights

"Tradefixa" is the sole owner of lawful licenses of all the rights intrested in the platform content. All title, ownership and intellectual property, rights, in the platform and platform content shall remain with Tradefixa or licensors, as the case may be. All rights not otherwise claimed under the terms or by Tradefixa are hereby reserved. Tradefixa and any other related icons and logo's are registered trademarks or service Mark's of "Rightview Digitech Pvt Ltd" in various jurisdictions and are protected under applicable copyright trademark and other proprietary rights laws. The unauthorized copying, modification, use or publication of these Mark's is strictly prohibited.

10. Notices

All legal notices or demands to or upon Tradefixa shall be made in writing and sent to Tradefixa personally by courier, certified mail, facsimile to following address "Rightview Digitech Pvt Ltd" 92, Mathni House, Vallabhbadi, Behind Central Square Mall, Gumanpura, Kota, 324007. The notices shall be effective when they are received by "Tradefixa" in any the above mentioned manner. All legal notices or demands to or upon a user shall be effective if either delivered personally, send by courier certified mail, by email to the last known correspondence fax or email address provided by the user to Tradefixa or by posting such notice or demand on an area of the platform that is publicly accessible without a change. Notice to a user shall be deemed to be received by such user if Tradefixa is able to demonstrate that communication, weather in physical or electronic form has been sent to such user immediately upon Tradefixa posting such notice on an area of the accessible without charge.

 

11. General provision

Tradefixa shall have the right to assign the term including all of rights, titles, obligations benefits interests and duties in the terms of any person or entity ( including any affiliates of Tradefixa). User may not assign in whole or part the terms to any person or entity.. The terms shall be governed by the laws of India and the parties to the terms agree to submit to the exclusive jurisdiction of the courts of Jaipur, Rajasthan, India. Tradefixa and user are independent contractors and no agency partnership joint venture, employee, employer relationship is intended or created by the terms. If any provision of the terms is held to be invalid or unenforceable, such provisions shall remain valid and be enforced. Tradefixa's failure to act with respect to any breach by user under the terms will not constitute a waiver of that right nor a waiver of Tradefixa's right to act with respect to subsequent or similar breaches.

12. Confidentiality

User must know that they will not disclose any information related to over portal to any third party or use except in connection with the performance of services hereunder any confidential information of Tradefixa business ("confidential information in the course hereof. Confidential information shall include Tradefixa software or portal"). specifications of Tradefixa software program and future development plans like research and development ( trade secrets of Tradefixa) indentities, contracts. Confidential information of users, confidential information of the website's use such as number of user, unique visitors and unique visits. You will give all the confidential information to Tradefixa within a month or within 30 days from the expiry or the early termination of this agreement. The obligations contained in this clause shall survive the termination of this agreement. Not with standing the forgoing, in the event Tradefixa receive a validity issued administrative or judicial order, notice warrant or other process that requires Tradefixa to share/disclose the confidential information then it shall be free to disclose all or part of the confidential information or is otherwise required to disclose any confidential information in order to comply with any law.

13. Fees & charges payable by seller

Seller will pay to Tradefixa on listing. If access to platform, applicable fee for use. Platform fee will be ascertained based on the criteria determined by Tradefixa and communicated to the seller from time to time. Seller must responsible to check such platform fee. In the event you continue to use the platform it shall be deemed hat you have agreed to such change in the platform fee. The platform fee shall be exclusive of all applicable taxes ( including goods & services tax ).Tradefixa shall issue the invoices for platform fee and other charges ( if any ), on seller and the seller shall make payment to Tradefixa.
